Terms of Service

By using Ecitron (the "Platform"), you accept these terms. If you accept on behalf of a company, you represent that you have authority to bind that company.

1. Beta

The Platform is in beta. It is provided "as is"; we make no commitment that it will operate uninterrupted or error-free. Features may change without notice. There is a risk of data loss — you are responsible for keeping your own backup of important data. Your account and data may be closed with 30 days' prior notice by e-mail.

2. Account

You are responsible for providing accurate information and for keeping your password confidential. An account belongs to one person; sharing credentials is prohibited. If you suspect unauthorised access, notify support@ecitron.com.

3. Right of Use and Restrictions

You are granted a non-transferable right to use the Platform in your own business activities. The following are prohibited:

• Reverse engineering the Platform or the calculation engine
• Copying, leasing, reselling, or making the Platform available to third parties
• Systematically collecting the engine's outputs in order to develop a competing product
• Attempting to circumvent security measures or to access other users' data
• Placing load beyond reasonable limits by means of automated tools
• Using the Platform unlawfully or in breach of sanctions or export control regulations

4. Engineering Responsibility — Important

The Platform is an engineering support tool. The results it produces are calculations based on the parameters you enter and on model assumptions.

These results are not a substitute for independent verification, design approval, or type testing by a competent engineer.

You are responsible for checking the accuracy of every result you rely on for production, quotation, or contract, its conformity with the applicable standards (IEC, EN, TS, IEEE, or local regulations), and its physical feasibility. Ecitron is not liable for damages arising from incorrect input, from model assumptions not matching your design, from manufacturing tolerances, or from the use of a result without verification. Price and quotation information generated through the Platform does not constitute a binding offer.

5. Intellectual Property

The Platform, the calculation engine, the algorithms, the interface, and the brand belong to Ecitron. These terms transfer no rights other than the right of use expressly granted.

The data you enter into the Platform belongs to you. Ecitron processes this data solely to provide, maintain, and secure the service. You may freely use the results you generate in your business activities; this creates no rights in the engine.

We may use aggregated usage statistics that do not identify you to improve the product. We may use feedback you send us without any obligation to you.

6. Confidentiality

Your data is your confidential information; the technical structure of the Platform and its unreleased features are ours. This obligation continues for 5 years after the agreement ends.

The processing of personal data is set out in the Privacy Policy.

7. Fees

The Platform is free during beta. Any transition to a paid version will be notified at least 30 days in advance and will require your express consent.

8. Termination

You may close your account at any time. Your account may be suspended without notice if you breach these terms, pose a security threat, or use the Platform unlawfully.

After termination, your data remains available for export for 30 days and is then deleted.

9. Warranty and Liability

To the extent permitted by law, the Platform is provided without any warranty. We are not liable for indirect damages such as loss of profit, loss of business, production stoppage, or loss of data.

Our total liability is limited to the amount you paid in the preceding 12 months. As that amount is zero during beta, the liability cap for this period is EUR 500.

These limitations do not apply in cases of wilful misconduct or gross negligence.

10. General

Assignment: You may not assign your rights without our consent. Ecitron may assign this agreement to its successor in the event of incorporation, merger, or transfer of business. You will be notified; no further consent is required.

Changes: These terms may be updated. Material changes will be notified 30 days in advance, and you will be asked to accept the new version before continuing. If you do not accept, you may terminate free of charge.

Governing law: Turkish law. Competent courts: the Courts and Enforcement Offices of Istanbul. Users acting as consumers retain the right to apply to the courts of their own place of residence.

Force majeure: We are not liable for delays caused by events beyond our control (natural disaster, cyber attack, infrastructure provider outage, regulatory change).

Language: In the event of any conflict between the Turkish and English versions, the English text prevails.
